eGift Card Terms & Conditions

GIBBON eGift Cards (“Gift Cards”) are issued by GIBBON North America, Inc. (“GIBBON,” “we,” or “us”) and may be redeemed exclusively for eligible merchandise on gibbon-usa.com. Gift Cards may not be used to purchase additional Gift Cards.  Gift Cards are available for purchase and use only by customers in the United States, are denominated in U.S. dollars, and are not offered, sold, or supported outside the United States.

No expiration & no fees

Gift Cards do not expire. No inactivity, dormancy, or service fees will ever be charged. 

Cash redemption & refundability

Gift Cards are non-refundable and may not be redeemed for cash or credit except where required by applicable law. California residents may, upon request, redeem a Gift Card for its cash value if the remaining balance is less than ten dollars ($10.00), as provided by California Civil Code § 1749.5. Residents of other states with similar cash-back requirements (for example, Colorado, Massachusetts, Montana, Oregon, Rhode Island, Vermont, and Washington) may redeem a remaining balance for cash to the extent, and at or below the threshold amount, required by the law of their state of residence. Balances & checkout

Any remaining balance after a purchase will remain on your Gift Card for future use. If your order total exceeds your Gift Card balance, an additional payment method will be required at checkout. To redeem a Gift Card, enter the Gift Card number in the gift card box at checkout on gibbon-usa.com; the available balance will be applied to your order. Gift Cards may be combined with promotional codes and other discounts, and more than one Gift Card may be applied to a single order. Where an order is paid using a Gift Card together with another payment method (split tender), the Gift Card balance will be applied first and the remaining order total charged to the additional payment method. The maximum value that may be loaded onto, or held on, a single Gift Card is five hundred U.S. dollars ($500.00). GIBBON may decline or limit Gift Card purchases or loads that would exceed this amount or that are otherwise inconsistent with these terms.

Limitation of liability & disclaimers

Treat your Gift Card like cash. Gift Cards are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, GIBBON disclaims all warranties, express or implied, with respect to Gift Cards, including any implied warranties of merchantability and fitness for a particular purpose. To the fullest extent permitted by applicable law: (a) GIBBON is not responsible for lost, stolen, damaged, or unauthorized use of Gift Cards, and lost or stolen Gift Cards will not be replaced without proof of purchase (such as your original order confirmation email or receipt), except where required by law; (b) GIBBON is not responsible for digital Gift Cards sent to an incorrect email address provided at checkout, and it is your responsibility to verify all recipient information before completing your purchase; and (c) GIBBON’s total aggregate liability arising out of or relating to a Gift Card will not exceed the remaining unused balance on that Gift Card, and GIBBON will not be liable for any indirect, incidental, special, consequential, or punitive damages. Nothing in this section limits any liability that cannot be limited or excluded under applicable law, or any rights you have under mandatory consumer-protection or unclaimed-property laws.

Refunds on Gift Card orders

For orders paid with a Gift Card, eligible refunds will generally be returned to the original Gift Card or issued as store credit.

Unclaimed property

Unredeemed Gift Card balances may be subject to state unclaimed-property (escheat) laws, which vary by state. Where required by applicable law, GIBBON will report and remit unredeemed balances to the appropriate state after the applicable dormancy period. Reporting or remitting a balance under an unclaimed-property law does not, by itself, extinguish the balance, and you may be able to recover amounts that have been remitted to a state by following that state’s claims process. This section does not shorten any period, or reduce any right, provided to you by the Gift Card or unclaimed-property laws of your state of residence.

Fraud & abuse

GIBBON reserves the right to refuse, cancel, hold, limit, or void Gift Cards and related orders where fraud, abuse, unauthorized activity, suspected resale, or violations of these terms are identified. Gift Cards obtained through unauthorized sellers or resellers may be void.

Governing law & dispute resolution

These terms, and any dispute or claim arising out of or relating to a GIBBON eGift Card or these terms, are governed by the laws of the State of California, without regard to its conflict-of-laws rules, except to the extent that the Gift Card, consumer-protection, or unclaimed-property laws of your state of residence provide rights that may not be waived or that apply notwithstanding a choice-of-law provision. Nothing in this section deprives you of the protection of mandatory consumer-protection provisions of the law of the state in which you reside.

Binding arbitration. Except as set out below, you and GIBBON agree that any dispute, claim, or controversy arising out of or relating to a Gift Card or these terms will be resolved by final and binding individual arbitration administered by a nationally recognized arbitration provider under its applicable consumer arbitration rules, rather than in court, except that either party may bring an individual claim in small-claims court. The Federal Arbitration Act governs the interpretation and enforcement of this section. This arbitration agreement does not prevent you from notifying or filing a complaint with any federal, state, or local government agency, which may seek relief on your behalf.

Class-action waiver. To the fullest extent permitted by applicable law, you and GIBBON agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of class or representative proceeding. If this class-action waiver is found unenforceable as to a particular claim or request for relief, then that claim or request for relief (and only that claim or request for relief) will be severed and may proceed in court, while all other claims will remain in arbitration.

Your right to opt out. You may opt out of this arbitration and class-action-waiver section by sending written notice of your decision to opt out to info@gibbon-usa.com within thirty (30) days after first purchasing or receiving a Gift Card. Your notice must include your name and the email or order associated with the Gift Card. If you opt out, the “Governing law” paragraph above still applies, but the arbitration and class-action-waiver provisions will not. This section does not apply to the extent prohibited by applicable law.

Changes to these terms

GIBBON reserves the right to update these terms at any time, subject to applicable law. If we make a material change to these terms, we will post the updated terms on gibbon-usa.com with a revised effective date and, where required by applicable law, provide advance notice (for example, by email to the address associated with the Gift Card purchase, where available) before the change takes effect. Changes will not apply retroactively and will not reduce the value of, or impose new fees or an expiration date on, Gift Cards issued before the effective date of the change, except where permitted or required by applicable law. Continued use of a Gift Card constitutes acceptance of any revised terms.
